Connecticut Foreclosed Homes Listings Facing New Type of Misconduct

Much of the foreclosure activity in the country today is facing intense scrutiny after flawed foreclosure operations around the country have been brought to light. One of the common cases that have placed foreclosures under investigation is called “robo-signing”.

Robo-signing is a situation where foreclosure documents are filed and signed by employees without verification. However, several recent foreclosure cases have shown a new form of foreclosure misconduct that are affecting Connecticut foreclosed homes listings and other foreclosures in the country. This misconduct basically involves false signatures of foreclosure attorneys.

The signature of a lawyer, who oversees the process, is crucial in foreclosure documents. For instance, before San Antonio foreclosures can be completed, the documents need to be signed by the attorney who reviewed and verified the said documents of the San Antonio foreclosures.

Unfortunately, there are now cases wherein the documents contain signatures from lawyers who apparently did not review the cases.

According to a lawyer and foreclosure expert, Max Gardner, this new misconduct features “a non-lawyer engaged in unauthorized practice of law, and that would be a serious problem in terms of that foreclosure judgment withstanding that kind of attack.”

The extent of the misconduct is yet to be determined. However, it has been discovered that some law firms, which specialize in foreclosures ready to go to Connecticut foreclosed homes listings and other foreclosures around the country, are allowing clerical staff employees to sign foreclosure documents on their behalf.

One of the lawsuits that brought this misconduct to light is a case in Pennsylvania where a lawyer form the Bank of New York admitted that his firm allowed staff members to sign documents on behalf of the lawyers. What’s worse is that the firm’s attorneys never reviewed or verified the documents.

According to lawyer Bob Davis Jr., having a non-lawyer to sign a document in behalf of the lawyer is not necessarily an illegal practice. However, it is mandatory that the lawyer still review the case.
