$10.2 Million Mesothelioma Lawsuit by a former paper mill worker, Henry Barabin, along with his wife against two companies the Scapa Dryer Fabrics Inc. and Asten Johnson Company. Recent studies indicated that both the companies used many materials and products with asbestos and that workers were exposed to high amount of it while working. Henry Barbin working for Scapa Dryer Fabrics Inc. and Asten Johnson as a laborer, between 1964-2001 and was diagnosed with malignant mesothelioma in early 2006.
He had evidence that during this tenure, he was constantly exposed to asbestos fiber and was not warned by the company officials about it. He and Geraldine Barabin hired a Texas Mesothelioma lawyer to fight their case and filed a $10.2 million lawsuit against the two companies for asbestos exposure resulting in him contracting mesothelioma cancer. The lawsuit was successful and the Texas jury awarded him with a compensation of $8 million in non economics damages and also a $1.5 million for loss of consortium claim. They also received an additional $700,000 for mesothelioma medical expenses.
Another such case is the workers being exposed to asbestos at DuPont. This case was filed by an employee of DuPont who died due to mesothelioma in 1970. He was working as a refinery worker who contracted the disease and who died due to it. His family sued DuPont for his death due to asbestos exposure at his workplace. The jury gave the decision in the favor of company in 2008 and the company DuPont de Nemours relieved. However, the trial judge was not happy with the decision of the jury and turned down the decision and granted a request for a new trial.
