Statistics show that November is by far the worst month For Pedestrian Accidents. November 28 and November 30 average of 11.8 accidents each day, nearly doubling the regular daily average of 6.1 accidents. The safest day of the year is Christmas Day, averaging only two accidents a day.

Recent statistics (obtained from the Toronto Transportation Services – traffic management centre) show that in 2009 there was 2189 pedestrian accidents in the city of Toronto. Out of that number, 2053 pedestrians’ sustained injuries and 31 pedestrians lost their lives. On average, most pedestrian accidents occurred on Fridays followed by Wednesdays. The majority of those pedestrian accident happened between the hours of 4pm and 5pm (rush hour). These statistics show that drivers have to be on the lookout for pedestrians, especially in the twilight hours; and pedestrians need to pay more attention to traffic.

There are a number of common reasons why pedestrian accidents occur. In some cases, it can be the fault of the pedestrian – for instance, a child may run out right in front of a car. If the car is already too close to come to a stop, it is likely that injury will occur. However, if the vehicle was speeding at the time of impact then it will be most likely classed as the fault of the driver, even though the pedestrian may have walked or run out in front of the vehicle. In the vast majority of cases however, it is not the fault of the pedestrian at all but the cause of driver negligence

The driver not paying attention or being pre-occupied
The driver speeding and not adhering to the limits set on that particular road
The driver failing to stop at pedestrian crossing and in other pedestrian right of way areas
A driver failing to pay and attention while driving the vehicle
A driver that is over the legal alcohol limit or has been taking drugs

Generally, pedestrian deaths rates are higher in urban areas. There is a higher ratio of deaths to injuries in rural areas because of higher impact speeds on rural roads. However, pedestrian accidents occur most frequently in urban areas because pedestrian activity and traffic volumes are greater compared to rural areas. Whether you have personally been injured or harmed in a pedestrian accident or whether you are the relative of someone killed as the result of a pedestrian accident caused by a negligent driver, you should seek legal assistance as soon as possible.
