Settlements Possible for DePuy Hip Replacement
The failed DePuyhipreplacement devices produced by Johnson & Johnson continue to cause the company financial difficulties. Reuters reports that Johnson & Johnson took a $3 billion hit this past quarter largely as the result of its defective DePuyhipreplacement parts.
The recall by the DePuy Orthopedics unit in 2010 of their hipreplacement devices was the result of the metal fragments that the devices shed that caused disabling injuries. According to analysts, the fourth quarter charges for the company are for funds that have been set aside to deal with patients in ongoing liability lawsuits.
The hipreplacement devices that were created to last longer than traditional implants ended up having a 30% failure rate. That is a rate that is over three times that of other similar medical devices. Since the 2010 DePuy recall, the company has been plagued by lawsuits from patients who suffered injury from the disintegrating parts.
DePuy is not the only facet of Johnson & Johnson that is suffering financial woes from litigation. Just last month, the company agreed to a settlement in excess of $150 million to settle a class action suit regarding its marketing of Risperdal to Medicaid patients.
Johnson & Johnson has already admitted its liability in the DePuyhipreplacement debacle by setting aside the funds in order to respond to lawsuits regarding the devices. One has to wonder, however, if enough funds have, in fact, been set aside given the number of patients that are still coming forward with injuries stemming from the hipreplacement devices.
Many personal injury attorneys are urging those who have received a DePuy ASR™ XL Acetabular Hip System or who are unsure of what type of hipreplacement device they have to contact their physicians as soon as possible for an examination, and then contact a personal injury attorney.
There is a strong possibility that DePuy devices were defectively designed and/or manufactured and that the company neglected to provide adequate warnings to patients. It is important that patients who may have had any sort of problem seek medical and legal help immediately because discovery forms are already being filed in many situations to verify that the devices were, in fact, among those that were recalled.
Not everyone who has a DePuyhipreplacement device will need to have it revised, but that the devices were recalled is enough reason for concern. If you or a loved one suspects that you may have had the recalled device implanted during hipreplacement surgery, make a point of consulting with a personal injury attorney as soon as possible.
