Business, Company and Domain Name Registration
Business Name Registration
A business name is the name under which your business operates. Registration of a business name is compulsory in every State or Territory in which you are doing business. To find out if a name is available and has not already been taken you should first search the National Names Index. If the name is available an application must be made in each relevant State or Territory.
Business name registration has to be renewed on a regular basis by payment of annual fees.
Company Name
In short, a company or registrable body is a body corporate registered in Australia under the Corporations Act 2001. A company name must be registered with the Australian Securities and Investment Commission (ASIC).
Unlike trade marks, company names do not necessarily provide proprietary rights for the use of the trading name.
Domain Name Registration
A domain name is an exclusive address on the internet which identifies your email and website. It must be registered with an authorised agent or reseller and hosted by an internet provider. There are many registration sites to choose from and a wide range of prices for .com, .net, .org and other URLs with various country designations.
Before you register a domain name you must first search to see that the name has not already been taken and is available to you. A user friendly site for both searching and registering a wide range of domain names is to be found at http://www.jumba.com.au Information relating to the different internet registers is available through the above site.
It is important to remember that registering a domain does not guarantee exclusive rights to that domain and many domain name squatters, people who register names or marks already used in business, have been forced to transfer those domains to the rightful owners who have been using those names in real market places.
Registering a business, company or domain name does not give you any proprietary rights. Only a trade mark can provide that kind of protection.
