If you have been injured as a result of an accident and are considering making a personal injury compensation claim, choosing the right organisation to help you could make all the difference between a smooth experience and a bumpy ride.
It is important you know what to look for before choosing who to take on your case. So where should you start?
Whether you are considering a legal services company, law firm or a claims management company to process your PI claim, there are important questions you need to ask:
1. Is the organisation properly registered to deal with personal injury claims? All legitimate organizations, whether they are a legal services provider, law firms or claims management companies, must be registered with the appropriate regulatory body.
2. Does the organisation have a proven record of successfully negotiating settlements of claims? This will give an indication of how frequently they deal with such claims and their experience in dealing with your type of claim.
3. Is the organisation interested in helping me to get better or are they only interested in my claim and their fee? Look at their website and see what they will do to help you rehabilitate after your accident and decide which one you think will best look after your particular needs.
4. Does the law firm or claims management company provide a clear explanation of how the legal fees and associated costs (including any medical expenses) will be covered? This is important as if you are not careful you could be liable for some or all of the costs associated with a claim. A few organisations do this well but many companies could do more to provide clarity on their fees.
5. How long will my claim take? You should look carefully at what each company says relating to the length of claim. Just because one company suggests that it can do things fast does not mean they will, and they may only be interested in winning your business. Its worth noting that personal injury claims invariably take a long time so a company that suggests longer times for settlement may only be being realistic in its approach.
6. Can I make a claim using Legal Aid to fund my claim? Legal aid is not available in most cases for personal injury cases, however many firms and claims companies offer their services on a ‘no win no fee’ basis, or will ensure that you do not have to pay any legal fees win or lose, but read their marketing materials carefully.
