What are Bail Bonds Guarantee
Bail Bonds are signed to guarantee the return of defendant to the court when summoned with the collateral security signed by a family or friend as co-signer who will be responsible to pay bail amount to the court if defendant fails to appear before the court of trial.
Bail Bonds are the guarantee furnished by a bail agent to the court in favor of the person posting for bail, based on a contractual agreement. These bail bonds guarantee for the appearance of the defendant in the court as and when required by the court. Thus bail bonds can be termed as a binding on the accused by signing a contract with a bail agent to present him when summoned by the court.
Bail agents come under contract with a defendant through bail bonds against a percentage of bail amounts for his services, as his fee. The main benefit of bail bonds is that it binds the defendant to lose the amount of bail if he fails to appear for trial before the court. Bail bonds are signed between the defendants or someone related to defendant and the bail agent for the release of the defendant, to arrange for a post bail. The family or friends co-sign the bail bonds to post bail as guarantor to pay off the amount of bail if the defendant fails to appear at the court when summoned.
Bail bonds do not require any security through collateral before the post of bail as the signature of a relative or friend is sufficient to bail out the defendant from jail. The co-signer signing the bail bonds must have a house, own or rented, in the area of bail and be employed to guarantee the bail amount. A bond is then posted for the amount of bail by the bail agent as a guarantee for the return of defendant at the court of trial. The cosigner holds the responsibility to make the accused available to the court as and when called by the court for trial otherwise he will be liable to pay the bail amount mentioned in bail bond and the expenses of searching him to the court.
The responsibility of the co-signer of the bail bonds, after entering into the agreement with bail agent, is to pay the full amount of bail immediately if the defendant fails to appear before the court for trial. The co-signer is also responsible to bear all the expenses incurred, if the defendant is searched out by the bail agent. In some cases, courts bail out the defendant if he deposits ten percent of the amount of bail bonds with collateral by a cosigner, if he is not able to pay full bail amount at a time.
