Teens Thrown from Car Headed to Hospital in Winston-Salem
Highway Patrol officers anticipate charging a driver who allowed minor passengers to go without seatbelts in a vehicle that blew a tire on U.S. 52 this past week. A six-year-old boy sustained injury when he was ejected from the Geo Tracker that was on its way to Wake Forest Baptist Medical Center in Winston-Salem.
The vehicle blew a tire while in the left lane of the highway near Midway. When the tire blew, the car traveled into the right lane, crashed into the guardrail, careened out of control, and finally landed on the median. In addition to the boy, a teenage girl was also ejected onto the grassy median and likewise sustained an injury.
Authorities believe that the flower-covered median, that was also fairly muddy, reduced the severity of the injury that the boy suffered. The boy and two others in the vehicle were then transported to the hospital for treatment. A fourth person declined assistance from EMS personnel.
Though officials are not releasing the name of the driver or any of the people involved, they say that the driver was not speeding. According to one of the Highway Patrol officers at the scene, the accident was caused by an equipment malfunction, which is why it is essential for people to wear seatbelts.
Because authorities are not releasing the name of the driver or of anyone who sustained an injury, it is impossible to know if this was a family that was traveling to Winston-Salem or if the driver was responsible for unrelated minors in the vehicle. However, if a child is injured in a vehicle because an adult did not insist on the wearing of a seatbelt, the child’s parents could pursue a personal injury claim on the child’s behalf.
In fact, it is possible for any passenger that suffers an injury in an accident to pursue a claim against the driver, if the driver is to blame for the injury. Many times, injury victims who were passengers at the time mistakenly believe that they should only contact a personal injury lawyer if it was the driver of the other vehicle that was at fault. However, anytime you suffer a personal injury through another’s negligence or recklessness, it is likely that you can file an injury claim.
