Checks and balances

Checks and balances is a constitutional right for the people of any country, which is entrenched in the constitution where the executive the legislature and judiciary have separated powers which acts as a control over one another. The executive has some powers which control the legislative and judiciary at the same time the legislative has some powers of controlling both the executive and the judiciary. Take for example the checks and balances for the state of Virginia where the senate controls the expenditure of the governor. And the states law courts controls the type of laws to be applied in that State.
To begin with, the legislative is allowed to make and enact laws authorize the state to spend and borrow as well sets the budget for the state. It also, ensures that there is enough funding through approving some projects for the state.’ It also sets laws which allow the appointment of judicial officials and sub members of the executive. In that way they are able to control the executive. The executive has enough power to refuse to spend some money which is allocated to them for some purposes if they feel the amount does not serve the interest of the people. They also act as the final authority in declaring war in any place. It also ensures the appointment of judicial officials who will be taken to the lower house of parliament for approval. Lastly in some countries they have powers to abandon convicted criminals under the judiciary.
The judiciary, being another arm of government controls the other two arms through ensuring that the law that is applied is consistence to moral justice and it also determines whether the law is unconstitutional. After parliament has enacted laws they are the people who will ensure that it is properly interpreted and the interpretation is constituted with constitution. The judiciary is entrenched to the constitution, their powers are well set out and it is through the Supreme Court where the constitution can be challenged.
In the state of Virginia, checks and balances, were brought to work when restructuring Virginias public education system in the year 2006. The legislature in Virginia passed a law which allowed the change of education system but there was conflict among the stake holders and this conflict was solved through checks and balances. The act which was passed by the house was challenged by the executive because of the interest of many stake holders on the issue. Many people thought the restructuring act was evolutionary however some doubted the viability of the project. Parliament has a portion some amount for the project in the institution but some members of the public decided to oppose it and they went to court. It was the court that decided the fate of the project.
